By accessing or using any services provided by Rezware LLC ("Company," "we," "us," or "our"), including but not limited to Portuguese AI and all related websites, applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

The Services provide AI-powered tools including but not limited to voice conversation, text chat, image generation, and search functionality. The Services are provided free of charge and are offered "as is" without any warranties or guarantees.

3. Free Software Disclaimer

THE SERVICES ARE PROVIDED FREE OF CHARGE. AS SUCH, REZWARE LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

You acknowledge and agree that your use of the Services is at your sole risk. Rezware LLC shall not be liable for any damages arising from your use of, inability to use, or reliance on the Services.

4. Third-Party AI Services

Our Services utilize artificial intelligence technologies provided by third-party vendors, including but not limited to:

• OpenAI (GPT models, DALL-E)
• Anthropic (Claude)
• Google (Gemini)
• OpenRouter
• ElevenLabs (voice synthesis)
• fal.ai (image generation)
• Other past, present, and future AI service providers

Rezware LLC is not responsible for the actions, outputs, availability, or policies of these third-party providers. Your use of our Services is also subject to the terms and conditions of these third-party providers. We may change, add, or remove third-party providers at any time without notice.

5. AI-Generated Content

Content generated by AI through our Services may be inaccurate, incomplete, misleading, or potentially harmful. You should not rely on AI-generated content for medical, legal, financial, or other professional advice. Always verify important information from qualified professionals and authoritative sources.

AI models may produce outputs that are biased, offensive, or inappropriate despite our efforts to prevent such occurrences. Rezware LLC is not responsible for any AI-generated content and disclaims all liability related thereto.

6. AI Training and Data Use

Your interactions with our Services may be used by third-party AI providers to improve their models in accordance with their respective policies. By using our Services, you acknowledge that your inputs and interactions may be processed by third-party AI systems.

We recommend not sharing sensitive, confidential, or personally identifiable information through our Services. Rezware LLC is not responsible for how third-party providers handle data processed through their systems.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REZWARE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content
• Any actions or outputs of AI systems
• Service interruptions, errors, or unavailability

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Rezware LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Services caused damage to a third party.

9. Acceptable Use

You agree not to use the Services to:

• Generate illegal, harmful, or abusive content
• Harass, threaten, or harm others
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to circumvent safety measures or content filters
• Generate content that sexualizes minors
• Create deepfakes or misleading media without consent
• Engage in automated abuse of the Services

We reserve the right to terminate or suspend access to the Services for violations of these acceptable use policies.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Your continued use of the Services after any modifications constitutes acceptance of the updated Terms.

11. Termination

We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Wyoming.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and Rezware LLC regarding the Services and supersede all prior agreements and understandings.
